These terms apply to anyone enquiring about, booking or listing accommodation with Prime Stays. This is a plain-English summary; final wording to be confirmed by a solicitor.
Prime Stays is an agent that arranges accommodation bookings in Edinburgh between property owners and guests. We are not the owner, provider or manager of any property, and we do not own, control or warrant it. By enquiring, booking or listing with us, you accept these terms.
You tell us your requirements; we offer suitable properties; on acceptance we confirm the booking. A booking fee secures it, and the accommodation balance and any deposit are payable as set out in the confirmation. The accommodation is provided under an arrangement between the owner and the guest, to which Prime Stays is not a party.
The owner is responsible for the property being as described, available for the booked dates, clean, safe and legally compliant, and for holding suitable buildings, contents and landlord insurance, for the property's utilities (all bills), council tax or non-domestic rates, and for any applicable Visitor Levy. We pass on property information in good faith but do not verify or warrant it.
Guests must occupy the property reasonably, follow the house rules, pay all sums due on time, and leave it in good condition. Guests are responsible for any damage beyond fair wear and tear caused by them or their party.
The booking fee is non-refundable once a booking is confirmed. The security deposit is refundable after check-out, less the cost of any damage or breach. Cancellation terms are set out in the booking confirmation.
Prime Stays acts only as agent. We are not liable for the acts or omissions of any owner or guest, for the condition, standard, safety or availability of any property, for non-payment or non-performance by an owner or guest, or for any loss, damage or dispute arising from a booking or stay. We are not liable for indirect or consequential loss. Nothing excludes liability that cannot lawfully be excluded (such as for death or personal injury caused by our negligence, or fraud).
You shall not, during your dealings with us and for twelve (12) months afterwards, bypass Prime Stays to book or deal directly with any owner, guest or contact first introduced to you by us. Property, owner and guest details we share are confidential and provided only to fulfil the relevant booking.
We use the contact and booking details you provide only to arrange and manage bookings, in line with data-protection law.

These terms are governed by the law of Scotland and are subject to the jurisdiction of the Scottish courts.
